Original Artwork Sales Policy & Terms of Purchase
These terms apply to the purchase of all original artworks created and sold by Nikesa Lowe.
1. Authenticity
All artworks sold are original, one-of-a-kind pieces and are accompanied by a Certificate of Authenticity confirming authorship by Nikesa Lowe.
2. Final Sale
All artwork purchases are considered final.
Due to the unique and non-returnable nature of original artwork, no refunds, returns, or exchanges will be permitted once the transaction has been completed.Buyers are encouraged to inspect the artwork carefully prior to purchase.
3. Transfer of Ownership
Ownership of the physical artwork transfers to the buyer upon receipt of full payment.
Copyright and intellectual property rights remain the exclusive property of the artist, Nikesa Lowe.4. Copyright & Reproduction Rights
The purchase of an original artwork does not grant the buyer the right to reproduce, distribute, modify, or commercially exploit the artwork in any form, including but not limited to prints, digital reproductions, or merchandise, without the prior written consent of the artist.
The artist retains the right to reproduce the artwork for portfolio, exhibition, promotional, and commercial purposes.
5. Permitted Use
The artwork is sold for private, personal display only.
Any use of the artwork for commercial purposes, resale, publication, or reproduction is strictly prohibited without written authorization from the artist.6. Care and Handling
Once the artwork has been transferred to the buyer, responsibility for its care and preservation rests solely with the buyer.
The artist is not liable for damage resulting from improper handling, environmental exposure (including sunlight, moisture, or heat), or normal wear over time.7. Damage in Transit (if applicable)
If the artwork is damaged during delivery or transport, the buyer must notify the artist within 48 hours of receipt, accompanied by photographic evidence. Claims submitted after this period may not be considered.
8. Pricing & Payment
Full payment is required at the time of purchase.
The artwork remains the property of the artist until payment has been received in full.9. Force Majeure
The artist shall not be held liable for any delay or failure to perform obligations due to circumstances beyond reasonable control, including but not limited to natural disasters, theft, or accidents.
10. Acceptance of Terms
By purchasing an artwork, the buyer acknowledges and agrees to these terms and conditions in full.
